Topinka v. Kimme

Plaintiff, as executor of estate, filed complaint alleging that he was entitled to approximately 1/3 of fund remaining in political committee after death of elected official who died while serving as State Comptroller. Plaintiff alleged that chair of political committee had converted and misappropriated committee funds, in violation of Election Code. Court properly found it lacked subject matter jurisdiction to hear claims, as State Board of Elections has original jurisdiction over alleged improper expenditures by political committee.(FITZGERALD SMITH and LAVIN, concurring.)
