Plaintiff was injured when he slipped and fell when, en route to laundry facility, he walked on a pile of snow and ice on sidewalk at his apartment complex.Pile of snow was open and obvious as a matter of law. Deliberate encounter exception does not apply, as Plaintiff knew there were multiple ways to reach laundry facility. Plaintiff failed to show that a reasonable person in his position would have found greater utility in walking over snow pile instead of using alternative path. (HARRIS and CAVANAGH, concurring).
