Illinois Appellate Court
Criminal Court
Sentencing
In 2002, court sentenced Defendant in absentia for unlawful possession of a controlled substance. In 2017, after being arrested, Defendant filed pro se motion for good cause hearing. Court erred in denying motion without an evidentiary hearing. Remanded for evidentiary hearing to determine whether Defendant's absence from sentencing was without her fault and due to circumstances beyond her control. (HARRIS and CAVANAGH, concurring.)
