Illinois Appellate Court
Criminal Court
Murder
Defendant was convicted of first degree murder. State's participation in Krankel inquiry, by presenting argument, was error but harmless beyond a reasonable doubt, under the circumstances, as argument likely had little or no influence on court's decision. Counsel's decision not to call witness was sound trial strategy, and counsel's argument as to DNA evidence met standard for competent representation. Thus, no ineffective assistance of counsel. (BARBERIS and GOLDENHERSH, concurring.)
