In dissolution proceeding, court properly granted husband's motion for declaratory judgment, finding premarital agreement valid and enforceable, and denying wife's motion to dismiss. Circuit court had subject-matter jurisdiction over the dispute. Court's ruling on husband's motion for declaratory judgment would terminate "some part" of the parties' controversy, which would determine whether the premarital agreement controls "various facets of the parties' rights in the pending dissolution proceeding. Court applied the correct law, the Premarital Agreement Act, in assessing validity of the agreement.No error in court's determination that, at the time of signing, the agreement would not give rise to an unforeseen condition of penury.
