Court erred in granting City's motion for summary judgment in its declaratory judgment action. Ameren has a statutory right to continue to serve its customers in recently annexed areas, under amended Municipal Code. Nothing in record shows that contractual agreement currently exists granting city a contractual right to service the newly annexed areas. (HARRIS and KNECHT, concurring.)
