Murder
Defendant was convicted, after jury trial, of 1st degree murder, attempted 1st degree murder, and unlawful use of a weapon by a felon.Defendant alleged that his trial counsel was ineffective by failing to strike from the jury a Will County correctional officer with whom Defendant had altercations in jail and who induced other inmates to harass Defendant by sharing details of his case. If true, then defense counsel's seating of that juror shocks the conscience, and no possible trial strategy would exist for doing so. Further proceedings on claims of ineffectiveness are warranted. McDADE and O'BRIEN, concurring.)
