Guilty Pleas
In 2015, Defendant, pursuant to a fully negotiated plea agreement, pled guilty to aggravated battery and retail theft. Defendant later filed a motion to withdraw his guilty plea, alleging that the did not understand the employment ramifications of pleading to a felony. The 2017 amendment to Section 113-4(c) of Code of Civil Procedure, which requires sentencing court ot admonish that a guilty plea may have an impact on defendant's ability to retain or obtain employment, is substantive and thus cannot be applied retroactively to Defendant's plea.
