Plaintiff was found eligible to receive vocational rehabilitation services from DHS Division of Rehabilitation Services; he then sought $5017 in funding to enroll in paralegal certificate program. DHS denied request, because Plaintiff had a J.D. degree and had practiced law in California for 5 years. Hearing officer issued final administrative decision affirming the determination, and circuit court affirmed. Evidence shows Plaintiff's qualifications and abilities and supports DHS's justification for denying him funding. Evidence that training may be useful does not establish by preponderance of evidence that such training is necessary.
