Illinois Appellate Court
Criminal Court
Felony Murder
Defendant was convicted, after jury trial, of felony murder, 2nd degree murder, unlawful possession of a firearm by a felon, and aggravated discharge of a firearm. He was sentenced to 53 years for felony murder and a concurrent term of 14 years for unlawful possession of a firearm by a felon. Conviction of felony murder must be reversed for lack of a predicate offense. Although court violated Defendant's due process by failing to follow Illinois Supreme Court Rule 430 before requiring him to wear an electric stun cuff during trial, this error was harmless. (DeARMOND and TURNER, concurring.)
