Wrongful Death
Wrongful death action filed alleging that pharmacy was negligent in improperly filling a prescription for infant, resulting in infant being given multiple doses of Lovenox at higher than intended dosage. The syringes were prefilled but syringes did not have any demarcations or numerical measurements. This negligence claim falls outside the purview of the learned intermediary doctrine, and any applicable exceptions would be irrelevant. (HYMAN and WALKER, concurring.)
