Defendant appealed circuit court order denying him leave to file a successive post-conviction petition challenging his 75-year sentence for murder. Defendant was 17 years old at the time of the offense and argued the sentence was a de facto life sentence and was imposed without adequate consideration of his youth and its attendant characteristics. The appellate court affirmed, finding that defendant was not subject to a de facto life sentence because he was eligible to be released in 37.5 years with day-for-day good conduct credit.
