Bayview Loan Servicing LLC v. Starks

Defendant defaulted rial court entered an order of default and a judgment of foreclosure in favor of the plaintiff. The trial court denied defendant’s motions to vacate the default judgment and for leave to file an untimely answer and counterclaims and defendant appealed. The appellate court affirmed, finding the defendant did not provide a basis for vacating the default judgment and, as a result, that the trial court did not abuse its discretion in denying the motion.
