Plaintiffs filed an action alleging that the City of Chicago violated section 11-208.3(b)(10) of the Illinois Vehicle Code when it imposed fines in excess of $250 for ordinance violations. The circuit court granted defendant’s motion to dismiss with prejudice and plaintiffs appealed. The appellate court reversed, finding that the circuit court erred when it concluded that the $250 figure in subsection (b)(10) was a legislative drafting error and remanded for further proceedings.
