Defendant was convicted of two counts of criminal sexual assault, one count of aggravated criminal sexual assault, and two counts of criminal sexual assault. He was sentenced to an aggregate term of 76 years in prison. On appeal, defendant argued that he was denied the effective assistance of counsel when counsel failed to move to dismiss the aggravated criminal sexual assault count as time-barred. The appellate court reversed defendant’s conviction for aggravated criminal sexual assault and remanded for resentencing on the lesser-included offense of criminal sexual assault.
