Respondent hospital appealed from an order of the circuit court granting petitioner’s petition for discovery pursuant to SCR 224, arguing that it was improper for the trial court to allow discovery of records of a child’s biological mother while the child was in utero because the mother did not consent to the release of those records. The appellate court found that the prenatal care medical records were discoverable because those records are, for all practical purposes, also the records of the child. The appellate court remanded with instructions for the trial court to review and redact the records to remove any information not ascertaining to the identity of the person who may be responsible for damages.
