Sovereign Immunity
Question on appeal was whether a private entity that later becomes owned by the state is entitled to sovereign immunity from an alleged breach of contract entered into while it was a privately owned entity. The appellate court found that it was and affirmed the order entered by the trial court dismissing the lawsuit on the basis that the defendant was entitled to sovereign immunity and that plaintiff’s action for damages must be brought in the court of claims.
