Quigg v. Saleem

Plaintiff filed a verified complaint and motion for preliminary injunction seeking a declaratory judgment that the defendant had breached the terms of a stock sale agreement and injunctive relief pursuant to that agreement. Two days later plaintiff made an oral motion for a temporary restraining order that was granted by the trial court, subsequently ordering that the restraining order stay in effect until a hearing was held on the preliminary injunction. Defendant appealed, arguing that the trial court erred in entering the TRO without notice. The appellate court agreed and reversed and remanded for further proceedings.
