Casey v. Rides Unlimited Chicago, Inc.

Trial court granted an attorney fee petition brought under section 10a(c) of the Consumer Fraud and Deceptive Business Practices Act, but substantially reduced the amount awarded. Plaintiff appealed. The appellate court adopted the framework for determining attorneys fees contained in Hensley v. Eckerhart, 461 U.S. 424 (1983), but reversed and remanded for further proceedings because it could not determine from the record the trial court’s reasons for reducing the fee and whether it was consistent with Hensley.
