Plaintiff filed a complaint against his former employer alleging a violation of the Illinois Personnel Record Review Act and asked that the circuit court compel the employer’s compliance with the Act in addition to paying a penalty and attorney’s fees. Defendant argued in a motion for judgment on the pleadings that the Act permitted only the employee to request to inspect any personnel documents and that the request for records was not made in compliance with the Act because it was made by the employee’s attorney. The circuit court granted the defendant’s motion and plaintiff appealed. The appellate court agreed that the plaintiff’s request for personnel records was not in compliance with the Act and affirmed the judgment of the circuit court. (DELORT and HOFFMAN, concurring)
