Health Care Right of Conscience Act
Plaintiffs filed a complaint against their employer pursuant to the Health Care Right of Conscience Act, alleging that the employer discriminated against them by terminating their employment for refusing to obtain a Covid-19 vaccine. The trial court dismissed the complaint under section 2-619 and the plaintiffs appealed. The appellate court affirmed, finding that section 13.5 of the Act removed measures to prevent contraction or transmission of Covid-19 from the protection of the Act and applied to all actions commenced or pending on or after its effective date.
