Erie Insurance Exchange v. Aral Construction Corporation

Declaratory judgment action where the plaintiff insurance company sought a declaration that it was not obligated to defend or indemnify the defendant construction company under a commercial general liability policy in an underlying suit premised on personal injury. Plaintiff argued that the insured failed to provide it with proper notice and that coverage was barred under the “auto exclusion” provision of the insurance policy.
