Motion to Suppress
State appealed from an interlocutory order granting in part the motion of the defendant to suppress evidence that police seized while executing a warrant to search the defendant’s residence. The State argued that the suppressed evidence, a firearm, was properly seized because it was in plain view. The appellate court agreed and reversed the portion of the order suppressing the gun.
