Defendant was convicted of first-degree murder and three counts of aggravated discharge of a firearm. He appealed from the trial court’s partial denial of his motion to suppress statements made during a custodial interrogation, arguing that the detectives used an improper “question first, warn later,” technique and that his Miranda waiver was not knowing and voluntary. The appellate court affirmed, finding that the trial court did not err in suppressing statements made pre-Miranda, but allowing the statements made post-Miranda and that the record established defendant’s statements were voluntarily made.
