Milton v. The Boeing Co.

Permissive interlocutory appeal of the trial court’s denial of the defendant’s forum non conveniens motion. The appellate court affirmed, finding that the trial court did not abuse its discretion in denying the motion when considering the appropriate factors, including that the product that caused the injury giving rise to the lawsuit was regularly utilized in Cook County, the parties were represented by Chicago law firms, defendant did not submit any affidavits from witnesses stating that traveling to testify would be difficult, and the trial court found that there was a high likelihood that most witnesses would testify by video.
