Illinois Appellate Court
Civil Court
Personal Injury
Plaintiff filed a two-count complaint for personal injuries after she fell while she was walking on a pedestrian bridge maintained by the defendant, City of Naperville. The trial court granted defendant’s motion for summary judgment and plaintiff appealed. The appellate court affirmed, concluding that the city lacked actual or constructive notice of the defect and, as a result, the trial court did not err when it granted summary judgment for the defendant.
