Illinois Appellate Court
Civil Court
Jurisdiction
Respondent appealed from a trial court order entering a default judgment against him finding that he was an unfit parent and terminating his parental rights. Respondent argued on appeal that the trial court did not have jurisdiction over him because the State did not conduct a "diligent inquiry" into his location under section 2-16(2) of the Juvenile Court Act. The appellate court reversed, finding that it could not conclude that the search was diligent where the record was silent as to whether DCFS contacted respondent’s relatives for information on his location.
