Armed Habitual Criminal
Defendant was convicted of being an armed habitual criminal and was sentenced to 24 years in prison. Defendant argued on appeal that the evidence presented at trial was not sufficient to sustain his conviction, that the trial court erred in providing IPI No. 3.01 to answer a question from the jury, and that his mandatory supervised release should be reduced from three years to 18 months. The appellate court affirmed, finding that the evidence was sufficient and that there was no error in the jury’s instruction. The appellate court also held that defendant was not entitled to have a new version of the sentencing statute applied to him because it was amended after he was sentenced.
