Illinois Appellate Court
Criminal Court
Ineffective Assistance of Counsel
Defendant was convicted of first-degree murder and sentenced to 50 years in prison. On appeal, defendant argued that his trial counsel was ineffective for failing to call an expert witness on eye testimony and for failing to disclose a potential conflict of interest, and that he received an insufficient Krankel hearing where the trial court did not allow the defendant to present rebuttal evidence. Defendant also argued that the trial court improperly failed to get a waiver to hold the hearings over Zoom. The appellate court affirmed but remanded for a new sentencing hearing. (C.A. WALKER, concurring and TAILOR, concurring in part and dissenting in part.)
