Sentencing
Defendant, who was 16 years old at the time of the offense, was convicted of murder and attempted murder and was sentenced to 100 years in prison. In a prior appeal, the appellate court reversed and remanded for re-sentencing consistent with the adoption of youth-based sentencing factors. The trial court again imposed a 100 year sentence and the defendant appealed. The appellate court reversed and remanded for re-sentencing a second time, finding that because the trial court judge was predisposed to impose the same 100-year sentence he failed to give fair consideration to the statutory youth-based sentencing factors and the full range of sentences available under the new sentencing scheme.
