Defendant was convicted of domestic battery of an insulting or provoking nature and was sentenced to 24 months of probation and 30 days in the county jail. Defendant appealed, arguing that the trial court erred in admitting hearsay statements of the victim and that the evidence was insufficient to convict him. The appellate court affirmed, finding that the trial court’s admission of the victim’s statements did not violate the confrontation clause and that the statements had sufficient foundation for admission. The court also held that the evidence was sufficient to prove defendant guilty beyond a reasonable doubt even though the victim gave conflicting testimony. (BIRKETT and KENNEDY, concurring)
