Plaintiffs in a medical malpractice case appealed from a trial court order granting summary judgment in favor of a defendant medical imaging company on the grounds that a co-defendant doctor was not an employee or agent of the imaging company. The appellate court reversed and remanded, finding that there was a genuine issue of material fact because the record established that elements of both an employer-employee relationship and an independent contractor status existed.
