Appellate court considered whether a claim of tortious interference with inheritance expectancy was subject to the five-year statute of limitations for tort claims or the six-month statute of limitations for filing a will contest under the Probate Act. The appellate court reversed, finding that the trial court erred when it concluded that plaintiff’s claims were time-barred because plaintiff’s tort claim was based on documents obtained through discovery in a pending will contest and that adding the tort claims to the will contest matter, even where it fell outside the time limits set by the Probate Act, was not improper.
