Illinois Appellate Court
Civil Court
Civil Procedure
In an interlocutory appeal, the plaintiff appealed from a circuit court order denying plaintiff’s motion to compel arbitration with respect to counterclaims it asserted against the defendants. The appellate court affirmed, finding that the plaintiff exercised its contractual choice to litigate its disputes against the defendants and that the choice to litigate extended to the counterclaims.
