The City of Chicago, a non-party intervenor, and defendant the City of Chicago appealed from a final order in the circuit in favor of the plaintiffs, a collection of local and business real estate organizations. The issue on appeal was whether the circuit court erred by enjoining the Board of Elections from counting and reporting votes related to a referendum on the March ballot commonly known as “Bring Chicago Home,” which was an effort to create a graduated transfer tax on real estate in Chicago. The appellate court vacated and remanded, finding that the circuit court erred and instructing the court to dismiss the complaint for want to jurisdiction. (LYLE and NAVARRO, concurring)
