Plaintiff, a deputy with the Cook County Sheriff’s Office, was placed on unpaid suspension after an off-duty incident led to his arrest. The defendant also filed charges to terminate plaintiff’s employment. The administrative hearing board did not terminate his employment but imposed a suspension of 180 days and refused to award plaintiff back pay for a period of time where plaintiff was on unpaid suspension that exceeded 180 days. Plaintiff filed a lawsuit seeking a trial court order for mandamus to compel payment of back pay. The trial court dismissed the action because plaintiff’s exclusive remedy was under administrative review and the appellate court affirmed. (McBRIDE and COBBS, concurring)
