Following an automobile collision, a passenger in the vehicle who was also the named insured on the automobile policy filed an uninsured motorist claim with his insurance company. The vehicle was driven by his daughter, who was excluded from coverage under the father’s UM policy. The trial court held that he could not file a claim against anyone arising from the collision because he had explicitly excluded his daughter from coverage and he appealed. The appellate court affirmed, finding that the trial court did not err in dismissing the case because the father had complete control over the amount of coverage and chose to allow his daughter to drive his car despite having excluded his daughter from coverage.
