In a long-pending class action lawsuit involving the merger and sale of a company created to operate an ethanol plant, plaintiff appealed and defendants cross-appealed after the trial court dismissed part of plaintiff’s complaint, entered judgment in favor of plaintiff against one group of defendants and entered judgment in favor of a second group of defendants on the remaining claims. The appellate court affirmed in part, reversed in part, dismissed in part, vacated in part, and remanded with instructions. Among the key rulings, the appellate court reversed the grant of judgment in favor of the plaintiffs and then reversed judgment in favor of the defendants on one count of the complaint and remanded for a jury trial on that claim.
