Defendant appealed from a trial court order denying him pretrial release, arguing that the State failed to prove by clear and convincing evidence that the proof was evidence or presumption great that he committed a detainable offense, that he posed a real and present threat of any person or persons in the community, and that there was no condition or combination of conditions that could mitigate the threat posed or would reasonable ensure his appearance or subsequent charges. The appellate court affirmed, finding that the trial court did not abuse its discretion based on the evidence and on defendant’s prior threats and weapons violations as well as his underlying mental health issues.
