Illinois Appellate Court
Criminal Court
Pretrial Release
Defendant, who was charged with three counts of aggravated unlawful use of a weapon, appealed from a trial court order granting the State’s petition to deny him pretrial release. The appellate court affirmed, finding that defendant was charged with a detainable offense because one of the counts filed against him was non-probationable and that there was sufficient evidence from which the trial court could conclude that there was no condition or set of conditions of release that could mitigate defendant’s threat to the community.
