Defendant, who was charged with aggravated discharge of a firearm and unlawful possession of a weapon by a felon, appealed from a trial court order denying him pretrial release. The appellate court affirmed, finding that no clear and obvious error occurred with regard to the timing of the detention hearing because defendant waived the required timeline by requesting a continuance and that defendant could not establish the prejudice prong for his claim that the request for a continuance constituted ineffective assistance of counsel.
