Summary Judgment
Plaintiff filed a lawsuit for personal injuries after she fell on cracked pavement that was covered in ice and snow. The trial court granted summary judgment in favor of the defendants finding there was no genuine issue of material fact because plaintiff's contention that she was injured due to an unnatural accumulation of ice and snow was based on speculation and plaintiff appealed. The appellate court affirmed, finding that plaintiff’s speculation that the ice that caused her fall formed as a result of the underlying condition of the parking lot was not sufficient to survive summary judgment.
