Petition to Revive Judgment
Plaintiff appealed from the trial court’s dismissal of its petition to revive a prior judgment plaintiff obtained against the defendant. Plaintiff argued on appeal that the circuit court erred when it interpreted the law regarding revival of dormant judgments to require a party to petition for revival in the seventh year after entry of the original judgment. The appellate court reversed and remanded, finding that neither the applicable statute or cases construing it preclude a party from reviving a judgment within 20 years of the original judgment in the absence of a revival in the seventh year after judgment and that plaintiff’s petition was timely.
