Petitioner appealed from a decision of the Illinois Commerce Commission approving the respondent’s beneficial electrification plan under section 45 of the Electric Vehicle Act. On appeal, the petitioner argued that the commission lacked the authority to approve charging station rebates, that the rate cap must be narrowly calculated to include only the delivery service revenue requirement, that the rate cap should apply to all costs incurred, that bill and delivery credits should be included in determining the plan budget, and that the commission improperly abdicated its administrative responsibilities and delegated its rulemaking authority to respondent when it approved the final order with modifications and required a compliance filing. The appellate court affirmed, finding that the commission did not commit any errors and properly exercised its authority over the matter. (KNECHT and DeARMOND, concurring)
