Illinois Appellate Court
Civil Court
Abused and Neglected Child Reporting Act
Defendants appealed from an order of the circuit court reversing a final administrative decision of DCFS that denied plaintiff’s request to expunge an indicated finding of sexual exploitation against him under the Abused and Neglected Child Reporting Act. On appeal, DCFS argued the court erred by concluding that the director’s finding that plaintiff sexually exploited a minor was against the manifest weight of the evidence, that the director improperly considered hearsay statements, and that the DCFS investigation failed to comply with the relevant statutory timing requirements. The appellate court found not errors and affirmed the judgment of the trial court. (DOHERTY and LANNERD, concurring and DOHERTY, specially concurring)
