Defendant was found unfit to stand trial and was transferred to the Illinois Department of Human Services for treatment. On appeal, defendant argued that the trial court erred by failing to make a determination as to the least physically restrictive form of treatment. The appellate court affirmed in part and vacated in part and remanded to allow the trial court to select the least physically restrictive form of treatment that is therapeutically appropriate and consistent with defendant’s treatment plan and to clarify whether the treatment should be on an inpatient or outpatient basis.
