Illinois Appellate Court
Civil Court
Statute of Limitations
Plaintiff filed a complaint against defendant for breach of contract relating to an insurance policy issued by the defendant for a property owned by the plaintiff. The trial court granted the defendant’s motion to dismiss, finding that the complaint was untimely because it was filed after the contract’s one-year suit limitations period. The appellate court affirmed, finding that plaintiff was bound to the agreed-upon terms of the policy’s suit limitations provision. (McLAREN and HUTCHINSON, concurring)
