Illinois Appellate Court
Criminal Court
Charging Instrument
Defendant was found guilty of possession of child pornography and was sentenced to four years in prison. On appeal, defendant challenged the sufficiency of the evidence and argued that the trial court erred by allowing the State to amend the indictment during trial. The appellate court affirmed, finding that the trial court did not err in allowing the State to amend the indictment because the information amended was not required to be alleged in the charging instrument and that the evidence presented at trial was sufficient to prove defendant guilty beyond a reasonable doubt.
