Illinois Appellate Court
Civil Court
Attorney's Fees
In a dissolution of marriage case, respondent appealed from a trial court order disqualifying respondent’s attorney, who was also respondent’s mother, from representing him, holding respondent and his attorney in contempt after the attorney filed a second appearance after being disqualified, and ordering respondent to pay the attorney fees of petitioner’s attorney and the fee for the appointed child representative. The appellate court affirmed the trial court’s disqualification of respondent’s attorney and affirmed the section 508(a) and 506(b) attorney fee awards to the extent that they had already been paid but reversed the remainder of the award based on respondent’s inability to pay.
