Illinois Appellate Court
Criminal Court
Pretrial Release
Defendant appealed from the circuit court’s order granting the State’s petition for detention after he was arrested and charged with aggravated unlawful use of a weapon and other minor traffic offenses. The appellate court reversed and remanded for a new hearing, finding that the detention hearing was deficient because the State did not properly tender evidence it had in its possession relating to the flight risk of the defendant.
